Peshawar (ENN) A bench of Peshawar High Court, Peshawar granted bail to Anila who is accused of murdering a man by strangulating him in the name of honour.
Advocate Saifullah Muhib Kakakhel represented the accused.
The case against accused is that she strangulated the deceased with a dupatta at her residence because the deceased followed her after work. The body was later on taken to KTH hospital and dumped there by the accused.
The counsel argued that there is no direct evidence against the accused.
The counsel argued that CDR favours the accused and the duppata examined by forensic laboratory does not show whether the blood thereupon is of human nature or not and is not matched with blood group of deceased.
The counsel argued that CCTV camera at KTH hospital does not show the accused on the spot and she is being dragged in the case.
The counsel argued that merely contact amongst the accused and the deceased does not make a case of murder against her.
The counsel argued that there is no judicial evidence or eye witnesses to show that the offence has been committed at the residence of accused.
The counsel argued that benefit of doubt is always to be extended to the accused because its better to liberate hundred criminals than imprison one innocent person.
The bench of Justice Ishtiaq Ibrahim after hearing arguments of the counsel of accused admitted the accused to bail subject to provision of 2 sureties to the tune of 3 lac each.
